Same-sex Divorce is not recognized In Maryland

Same-sex marriage is not performed in Maryland. But recently the Attorney General (AG) of Maryland has recognized such marriages are being performed in other states of US. This has formed intricate legal issues.

The reason is- by law states must give full faith and credit to the laws of other states and recognize them as well. It means if other states are permitting same-sex marriages, Maryland too should follow it. But Maryland Catholic Conference is criticizing the opinion against such institution of marriage. Even some law-makers are strict in passing the laws.

Though this ruling doesn’t apply to Maryland, currently five states and the District of Columbia allow this type of reunions.

Now what makes Maryland to go against such unusual marriages?

The reasons are many among which complications related to same-sex divorce is the major one. Generally married same-sex couple can’t get a divorce simply from the same state. If they move they need to be careful. Because their marriages are not recognized by every state and if they want to get divorced, there is a fear of years of court actions and uncertainty.  It creates a dilemma as there seems to be no rules for divorce.

Conventional marriages and divorces are accepted when a couple moves to different states. For them there is no need to get re-married or re-divorced each time they relocate. But it doesn’t apply to legally-married gay couples.

There is a genuine question –if a state doesn’t recognize same-sex marriage how can it break up such a marriage?

Secondly divorce has an impact on factors like child visitation, property division, or any possibility to enter into new relationships and new marriages. Divorce issues can make all these matters confusing and complicated.

Hence, the US Supreme court need to intervene that would guide same-sex couples, Maryland Divorce Lawyer and judges on this tricky issue.
